Welcome to StreamerHomes.com (the "Platform"). StreamerHomes is operated by Brighter Ecommerce LLC, doing business as StreamerHomes and, from time to time, referred to herein as the Meeting Platform ("MP").
StreamerHomes was created to help connect video game streaming content creators who are interested in shared or live‐in housing arrangements. Having observed the growth of streamer houses and collaborative living arrangements around tournaments and content creation, we created this Platform to explore whether such housing can become a broader, community‐driven option. The Platform also enables Users to post for virtual collaboration partners ("Streammates") and to post in search of brand or product sponsorships, in each case as further described in these Terms.
By accessing or using StreamerHomes.com, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Platform.
1. Definitions.
For purposes of these Terms:
- "User" means any individual who accesses or uses the Platform, whether registered or unregistered.
- "Host" means a User who posts or lists a room, home, or other living space.
- "Seeker" means a User who views, responds to, or communicates regarding housing or room
listings.
- "Listing" means any post, description, image, message, or other content relating to housing or room availability.
- "Streammate Post" means a post created by a User for the purpose of finding another User to engage in virtual collaboration, including but not limited to co-streaming, co-op gameplay, screen-share sessions, or other remote content creation activities.
- "Sponsor Post" means a post created by a User for the purpose of making themselves discoverable to brands, advertisers, agencies, or other third parties interested in sponsorship, advertising, product placement, affiliate, endorsement, or similar promotional arrangements.
- "Streammate" means a User who responds to or is sought through a Streammate Post.
- "Sponsor" means any brand, business, advertiser, agency, individual, or other third party that responds to or initiates contact through a Sponsor Post. Sponsors may or may not be registered Users of the Platform.
- "Collab Listing" means, collectively, Streammate Posts and Sponsor Posts. References in these Terms to a "Listing" include Collab Listings, except where the context (e.g., references to housing, rent, or property) clearly limits the term to housing-related Listings.
2. Age Requirement.
Users must be at least 18 years of age to use the Platform.
3. Platform Role and Disclaimer.
StreamerHomes / MP is not a landlord, property manager, real estate broker, agent, or housing provider. MP does not own, manage, lease, inspect, or control any property listed on the Platform.
MP is not a party to any agreement, whether written or oral, between Users. Any lease, roommate agreement, rental arrangement, or other housing agreement is solely between the involved Users.
The Platform functions solely as a venue to post Listings and to facilitate communication between Users.
4. Listings and Content Disclaimer.
MP does not verify, guarantee, or warrant the accuracy, completeness, or truthfulness of any Listing or User communication. This includes, but is not limited to:
- Square footage
- Property or room condition
- Amenities
- Photographs or images
- Descriptions or representations of housing
All Listings and communications are provided by Users. Any reliance on such information is at your own risk.
5. No Vetting of Users.
MP does not conduct background checks, criminal history checks, credit checks, identity verification, or credential verification of any User, whether a Host or Seeker.
This includes, but is not limited to, the verification of:
- Streaming audience size, subscribers, or viewers
- Criminal history
- Personal background
- Living habits or personal conduct
- Users are solely responsible for performing their own due diligence and deciding whether to proceed with any housing or roommate arrangement.
MP has no obligation to verify the identity, background, or representations of any User.
6. Messaging and Communications.
The Platform includes a built‐in messaging system which allows Users to exchange messages and images for informational purposes.
Users are encouraged not to share sensitive information through the Platform, including contracts, financial details, or personal identification information. Email or other secure methods should be used for sensitive matters.
MP is not responsible for maintaining, archiving, securing, or preserving conversations or attachments and does not guarantee message delivery or retention. MP is not responsible for maintaining, archiving, securing, or preserving listings.
Ratings and Feedback. To maintain the integrity of the Platform, we may allow Users to leave public ratings and written reviews regarding their experience with other Users. You acknowledge that your conduct, communications, and representations on or through the Platform may be reflected in your public rating or review. We reserve the right, but have no obligation, to monitor, remove, or suppress ratings or reviews that we determine, in our sole discretion, are abusive, misleading, irrelevant, unlawful, or intended to manipulate the review process.
7. No Payments, Contracts, or Guarantees.
Current Status. Access to the Platform is currently free.
Future Fees. You agree to pay us any applicable fees that you have affirmatively agreed to pay on the Platform. Fees may include listing fees or other fees. Any such fees will be clearly disclosed. Listing fees are non-refundable once a listing begins, regardless of whether a living arrangement materializes.
Payment Methods. You must provide a valid payment method (e.g., credit card) to pay any applicable fees. You authorize our payment processor to charge the fees to your payment method. If we receive a chargeback/dispute regarding your payment, we may suspend your account and listings and have the right to recover from you any fees/costs resulting from the chargeback/dispute.
MP does not process, collect, hold, or transmit rent payments, deposits, fees, or any other financial transactions.
MP does not provide escrow services, guarantees of housing availability, or assurances regarding suitability, safety, or compatibility of any housing arrangement.
All financial arrangements and contractual agreements are solely between Users.
7A. Streammate Posts (Virtual Collaboration).
7A.1 Purpose. Streammate Posts allow Users to publicly indicate that they are seeking another User with whom to collaborate virtually, including by co-streaming, playing games together, sharing screens, or otherwise creating content remotely. Streammate Posts are not housing Listings and do not contemplate any in-person meeting, shared residence, or physical contact between Users.
7A.2 Platform Role. MP is not a talent agency, manager, producer, broadcaster, casting service, or representative of any User. MP does not match, pair, screen, recommend, or endorse any User as a collaboration partner. The Platform functions solely as a venue for Users to post Streammate Posts and communicate with other Users.
7A.3 No Verification. MP does not verify, and makes no representation or warranty regarding, any information contained in a Streammate Post, including but not limited to: streaming platforms used, channel ownership, follower or subscriber counts, games played, equipment or setup, time zone or availability, age, identity, skill level, or content-creator status. Users are solely responsible for independently confirming any representation made by another User before engaging in a collaboration.
7A.4 No Guarantee of Collaboration or Audience Outcomes. MP does not guarantee that a Streammate Post will result in any collaboration, partnership, audience growth, view count, follower count, revenue, or other outcome. Any expectation of mutual benefit, exposure, or compensation arising from a collaboration is a matter solely between the Users involved.
7A.5 Collaboration Arrangements Are Between Users. Any agreement to collaborate, including but not limited to scheduling, content ownership, revenue sharing, credit, conduct on stream, use of voice or likeness, recording, archiving, re-uploading, or termination of the collaboration, is solely between the Users involved. MP is not a party to any such agreement. Users are strongly encouraged to confirm expectations in writing before going live or recording together.
7A.6 Content Captured During Collaborations. Users acknowledge that virtual collaborations may involve the capture, transmission, or broadcast of voice, video, gameplay footage, chat, or other content involving multiple parties. Each User is solely responsible for: (a) obtaining any consent required to record, stream, or distribute another User's voice, likeness, gameplay, or contributions; (b) complying with the terms of service of any third-party streaming, voice, or screen-share platform used in connection with the collaboration; and (c) complying with all applicable laws regarding recording, consent, and broadcasting.
7A.7 Third-Party Platforms. Streammate Posts may reference third-party services (such as Discord, Parsec, Twitch, YouTube, Kick, or similar). MP does not control, endorse, or assume any responsibility for any third-party service, and your use of any third-party service is governed solely by that service's own terms and policies.
7A.8 Safety. Users are reminded not to share sensitive personal information (such as home address, financial information, government identifiers, or login credentials) with a prospective or actual Streammate. MP is not responsible for any harm, loss, harassment, doxxing, stalking, harm to reputation, or other consequence arising from a collaboration or attempted collaboration between Users.
7B. Sponsor Posts (Brand Collaboration).
7B.1 Purpose. Sponsor Posts allow Users to publicly indicate that they are open to sponsorship, advertising, product placement, affiliate, endorsement, or similar promotional arrangements with brands, businesses, agencies, or individuals. Sponsor Posts are not housing Listings and do not contemplate any in-person meeting or shared residence.
7B.2 Platform Role. MP is not an advertising agency, talent agency, marketing representative, broker, intermediary, or affiliate network. MP does not solicit sponsors on behalf of Users, negotiate sponsorship terms, set rates, vet brands, or guarantee that any brand will respond to or accept any Sponsor Post. The Platform functions solely as a venue for Users to publish Sponsor Posts and to be contacted by potential Sponsors.
7B.3 No Verification of User Information. MP does not verify, and makes no representation or warranty regarding, any information contained in a Sponsor Post, including but not limited to: identity of the User, ownership of any listed channel, follower or subscriber counts, viewership statistics, engagement rates, audience demographics, prior brand work, equipment, games played, time zone, or willingness or ability to perform any listed sponsorship activity (such as shoutouts, product endorsements, pinned comments, or other promotional services). Users are solely responsible for the accuracy of all information they post and must not misrepresent their channels, audience, or capabilities.
7B.4 No Verification of Sponsors. MP does not verify, screen, background-check, or endorse any brand, business, advertiser, agency, or individual that may respond to a Sponsor Post or otherwise contact a User through the Platform. MP makes no representation that any prospective Sponsor is legitimate, solvent, authorized to enter into agreements, free of intellectual-property or other legal claims, or able or willing to pay. Users are solely responsible for performing their own due diligence on any prospective Sponsor, including verifying the Sponsor's identity, business legitimacy, and creditworthiness, before agreeing to any sponsorship, accepting any product, or producing any sponsored content.
7B.5 Sponsorship Arrangements Are Between the User and the Sponsor. Any sponsorship, advertising, affiliate, endorsement, product-supply, or similar arrangement entered into as a result of a Sponsor Post is solely between the User and the Sponsor. MP is not a party to any such arrangement and is not responsible for negotiating, drafting, enforcing, or interpreting any sponsorship agreement, payment obligation, deliverable, exclusivity term, performance metric, or termination right. Users are strongly encouraged to put all sponsorship terms in a written agreement signed by both parties before performing any sponsored activity or accepting any product or payment.
7B.6 No Payments Through the Platform. MP does not process, collect, hold, escrow, transmit, invoice, or remit any sponsorship payment, product, gift, commission, or other consideration between a User and a Sponsor. All such transfers occur outside the Platform and are solely the responsibility of the parties involved.
7B.7 Legal Compliance for Sponsored Content. Users are solely responsible for complying with all laws, regulations, guidelines, and platform policies applicable to sponsored, paid, or endorsement content, including but not limited to: (a) the U.S. Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising and any equivalent disclosure rules in the User's jurisdiction; (b) advertising disclosure requirements of the streaming or social platforms on which the sponsored content appears (e.g., Twitch, YouTube, Kick, TikTok, Instagram); (c) tax reporting and withholding obligations on sponsorship income; (d) laws restricting the advertising of regulated products (such as alcohol, tobacco, cannabis, firearms, gambling, financial products, supplements, or pharmaceuticals); and (e) restrictions on advertising directed to or involving minors. MP makes no representation that any Sponsor Post or sponsored arrangement complies with such requirements, and the responsibility lies entirely with the User.
7B.8 Prohibited Sponsorship Content. Users may not use Sponsor Posts to: (a) solicit or promote any unlawful product, service, or activity; (b) solicit sexually explicit, adult, or pornographic sponsorships; (c) solicit sponsorships for content that exploits, targets, or is directed at minors; (d) misrepresent audience size, demographics, engagement, or prior brand work; (e) sell, transfer, or rent access to another person's channel or audience; (f) solicit "pay-for-positive-review," undisclosed-endorsement, or other arrangements that would violate applicable advertising-disclosure law; or (g) solicit multi-level marketing, pyramid, "get rich quick," or similar schemes. MP reserves the right to remove any Sponsor Post or restrict any User in its sole discretion.
7B.9 No Guarantee of Outcome. MP does not guarantee that a Sponsor Post will result in any sponsorship, contact from a brand, offer, product, payment, or other outcome. Any expected value, exposure, or earnings is solely between the User and the Sponsor.
7B.10 Third Parties Contacting the Platform. Where a Sponsor (whether or not a registered User) initiates contact with a User in response to a Sponsor Post, MP is not responsible for the conduct, communications, representations, or solvency of such Sponsor. Users should treat any contact, offer, or product received from a prospective Sponsor with appropriate skepticism and should not provide login credentials, banking information, government identifiers, or signed contracts to any party they have not independently verified.
8. User Responsibilities and Legal Compliance.
Users agree to comply with all applicable federal, state, and local laws, regulations, and ordinances, including but not limited to:
- Fair housing laws
- Anti‐discrimination laws
- Zoning and occupancy laws
- Lease, HOA, or landlord restrictions
Users are solely responsible for ensuring that their Listings and conduct on the Platform are lawful.
9. Anti‐Discrimination Policy.
Users agree not to use discriminatory language or practices in Listings, messages, or other communications.
Discrimination includes conduct prohibited under applicable federal, state, or local housing laws protecting certain classes of individuals.
MP reserves the right to remove content or restrict access that it believes, in its sole discretion, violates this policy.
10. Content Ownership and License.
Users retain ownership of the content they submit to the Platform.
User Content. By posting photos, videos, text‑based documents, descriptions and other content (“User Content”), you grant us a perpetual, non-exclusive, worldwide, royalty-free license to host, store, use, display, reproduce, modify, adapt, create derivative works of, publish, and distribute User Content for the purpose of operating and promoting the Platform or improving our services. You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to submit your User Content and to grant the rights you grant to us under these Terms, and that your User Content does not violate any law or infringe or misappropriate any third-party rights.
11. Prohibited.
11.1 Interference with the Platform: You may not access, use, or interfere with the Platform except through the interfaces we provide. Without limiting the foregoing, you will not (a) deploy or use bots, spiders, scrapers, crawlers, or other automated means to access, query, copy, or monitor the Platform; (b) introduce or attempt to introduce viruses, worms, logic bombs, backdoors, Trojan horses, malware, or other harmful code; (c) probe, scan, or test the vulnerability of any system or network or circumvent any security or authentication measures; (d) attempt to gain unauthorized access to any accounts, systems, data, or networks; (e) interfere with or disrupt the operation or performance of the Platform or any related network, including by flooding, mail‑bombing, overloading, or denial‑of‑service attacks; (f) frame, mirror, or otherwise display the Platform within another website or service without our prior written consent; or (g) use the Platform in a manner that imposes an unreasonable or disproportionately large load on our infrastructure.
11.2 Reverse Engineering:
Except to the extent prohibited by applicable law, you may not frame, mirror, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying ideas of the Platform or any related software, nor assist or permit any third party to do so.
12. File Upload Restrictions.
When creating listings or communicating via the Platform, you will upload
only files in the formats we permit and subject to our file size and other limits. You are strictly prohibited from uploading executable files, scripts, or other files intended to execute code (including but not limited to files with extensions such as .exe, .bat, .cmd, .sh, or .msi). We reserve the right to block, quarantine, or remove any file transfer that we deem a security risk.
13. Removal, Suspension, and Termination.
MP reserves the right, at its sole discretion, to:
- Edit Listings
- Remove Listings
- Restrict or suspend User access
- Ban Users from the Platform
These actions may be taken for any reason, including but not limited to violations of these Terms or applicable law.
14. Limitation of Liability.
To the fullest extent permitted by law, MP shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to:
- Use of or inability to use the Platform
- Listings or User communications
- Housing arrangements or disputes
- Personal injury, property damage, or loss
- Loss of income, streaming revenue, or business opportunities
- Streammate Posts, collaborations, or interactions between Users arising from Streammate Posts, including but not limited to disputes over content ownership, scheduling, conduct on stream, recording, redistribution, or audience or revenue outcomes
- Sponsor Posts and any sponsorship, advertising, affiliate, endorsement, or product-supply arrangement (whether entered into through the Platform or otherwise), including but not limited to non-payment by a Sponsor, non-delivery of products, breach of any sponsorship agreement, regulatory or disclosure violations, intellectual-property or right-of-publicity claims, tax liabilities, or fraud, misrepresentation, or other misconduct by a Sponsor or User
Users use the Platform at their own risk.
15. Indemnification.
Users agree to defend, indemnify, and hold harmless MP, Brighter Ecommerce LLC, and their affiliates from any claims, damages, losses, liabilities, and expenses arising out of:
- User content or Listings
- User conduct
- Violations of these Terms
- Violations of applicable law
16. Modifications to Terms.
MP reserves the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
17. Moderation.
We have the right, but not the obligation, to monitor User Content. We may remove
content that violates these terms or is deemed inappropriate (e.g., profanity, adult/illegal/harmful content, etc.).
18. Our Intellectual Property.
The Platform, including its “look and feel,” user interface, design, layout,
software, code, features, functionality, and all content, materials and services made available by us on or through the Platform (excluding User Content) (collectively, “Platform Materials”), are owned by or licensed to us and are protected by intellectual property and other laws.
Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, publicly display, publicly perform, create derivative works from, sell, license, rent, lease, transfer, or otherwise exploit any Platform Materials. All rights not expressly granted are reserved by us.
“StreamerHomes.com,” “StreamerHomes,” and all related names, logos, product and service names, designs, and slogans are trademarks of us or our licensors. You may not use such marks without our prior written permission.
19. Feedback.
If you submit to us any ideas, suggestions, proposals, improvements, or other feedback regarding the Platform (collectively, “Feedback”), you agree that such Feedback is provided voluntarily and without restriction. You grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up right and license to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose,
without compensation or credit to you.
20. Copyright Infringement (DMCA).
We respect intellectual property rights. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us by mail, at the address the end of this ToS. In accordance with the Digital Millennium Copyright Act (DMCA), we will remove infringing content and may terminate the accounts of repeat infringers.
21. General
21.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which Brighter Ecommerce LLC is organized, without regard to conflict of law principles.
21.2 Class Action Waiver. To the fullest extent permitted by law, you agree that you may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.
21.3 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remainder will continue in full force and effect. To the extent a court determines a provision cannot be enforced as written, the court is
authorized to reform such provision to the closest lawful meaning and scope that most nearly reflects the parties’ original intent and economic allocation of risk.
21.4 Electronic Communications; Electronic Signatures; Notices. By accessing or using the Platform, you consent to receive communications from us electronically, including via email, through your account, or by postings on the Platform. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
- Electronic Signatures / Acceptance: You agree that your affirmative act of registering for an account, clicking an “I Agree,” “Accept,” or similar button (or check box), or otherwise accessing or using the Platform constitutes your electronic signature and your acceptance of, and intent to be bound by, these Terms and our Privacy Policy.
- Notices to You: We may provide notices to you by emailing the address associated with your account, by message within the Platform, or by posting the notice on the Platform. You are responsible for keeping your email address current and for checking your email and the Platform for notices.
- Notices to Us: Unless a specific section of these Terms provides a different method, notices to us must be sent to the address at the bottom of this Terms of Service.
21.5 Assignment. You may not assign, transfer, or delegate any of your rights or obligations under these Terms (by operation of law or otherwise) without our prior written consent. Any attempted assignment, transfer, or delegation without such consent is void. We may assign, transfer, or delegate these Terms (in whole or in part) without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
21.6 Entire Agreement. These Terms, together with the Privacy Policy and any additional policies or guidelines we post on the Platform (each as may be updated from time to time), constitute the entire agreement between you and us regarding your access to and use of the Platform, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Platform. If there is a conflict between these Terms and any other policy or guideline (other than the Privacy Policy), these Terms will control to the extent of the conflict.
21.7 Force Majeure. We will not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure results from events, circumstances, or causes beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, labor disputes, power or internet outages, interruptions or failures of hosting or telecommunications providers, governmental actions, or failures of third-party services (“Force Majeure Event”). Our performance will be deemed suspended for the period that the Force Majeure Event continues.
21.8 Twitch Login. By registering or signing in using Twitch, you authorize StreamerHomes to receive basic profile information from Twitch Interactive, Inc., including your Twitch username, profile photo, and channel URL, solely for the purpose of creating and maintaining your StreamerHomes account. We do not access your Twitch subscribers, stream data, chat logs, or any other Twitch data beyond what is necessary to authenticate your identity and populate your profile. Your use of Twitch Login through StreamerHomes is subject to Twitch's Terms of Service and Privacy Notice. You may request deletion of all data associated with your Twitch Login by visiting our Data Deletion Request page. Twitch is not responsible for the content or operation of StreamerHomes.
21.9 Google Login. By registering or signing in using Google Sign-In, you authorize StreamerHomes to receive basic profile information from Google LLC, including your Google account ID, name, email address, and profile photo, solely for the purpose of creating and maintaining your StreamerHomes account. We request only the "openid," "profile," and "email" OAuth2 scopes and do not access your Gmail, Google Drive, Google Calendar, Google Contacts, YouTube account data, YouTube channels, watch history, subscriptions, or any other Google service data beyond what is necessary to authenticate your identity and pre-populate your StreamerHomes profile. Your use of Google Sign-In through StreamerHomes is subject to Google's Terms of Service and Google's Privacy Policy. You may revoke StreamerHomes' access to your Google account at any time via your Google Account permissions at https://myaccount.google.com/permissions. You may also request deletion of all data associated with your Google Login by visiting our Data Deletion Request page. StreamerHomes is solely responsible for this platform and its use of your data — Google is not responsible for the content or operation of StreamerHomes.
21.10 Discord Login. By registering or signing in using Discord, you authorize StreamerHomes to receive basic profile information from Discord Inc. (or, for users in the European Economic Area, Discord Netherlands B.V.), including your Discord user ID, username (and display name, if set), email address, and avatar, solely for the purpose of creating and maintaining your StreamerHomes account. We request only the "identify" and "email" OAuth2 scopes and do not access your Discord servers (guilds), guild memberships, direct messages, voice or text channels, friend list, connections, or any other Discord data beyond what is necessary to authenticate your identity and pre-populate your StreamerHomes profile. Your use of Discord Login through StreamerHomes is subject to Discord's Terms of Service and Privacy Policy. You may revoke StreamerHomes' access to your Discord account at any time through your Discord account settings under "Authorized Apps" at discord.com, or by visiting your Discord User Settings > Authorized Apps. You may also request deletion of all data associated with your Discord Login by visiting our Data Deletion Request page. StreamerHomes is solely responsible for this platform and its use of your data — Discord is not responsible for the content or operation of StreamerHomes.
21.11 Social Login & Imported Profile Data. When you register using any supported third-party social login provider (Twitch, Google, or Discord), StreamerHomes may automatically import available profile data including your display name, profile photo, and associated platform channel URLs to pre-populate your StreamerHomes profile. By completing registration you acknowledge and agree to this usage. All imported data is editable from your profile settings and may be deleted upon request via our Data Deletion Request page.
